Title 28 › PART II — DEPARTMENT OF JUSTICE › CHAPTER 33 — FEDERAL BUREAU OF INVESTIGATION › § 540D
Require the FBI Director to use multidisciplinary teams for every FBI probe of child sexual exploitation, production of child sexual abuse material, or child trafficking (called a "covered investigation"). The law names a few terms: "child sexual abuse material" refers to the visual depictions in 18 U.S.C. 2256(8)(A); "relevant children’s advocacy center personnel" means CAC staff who work in joint child-support settings; and a "victim advocate" is a paid or volunteer person who helps victims. The FBI must use a trained FBI child-adolescent forensic interviewer or, if none is available, a trained forensic interviewer from a children’s advocacy center. The FBI should work with and coordinate CAC-based teams, encourage CAC collaboration, and make victim advocates available to every victim reporting child sexual abuse or trafficking, no matter the victim’s age. Teams must include investigators, mental health and medical professionals, victim advocates or specialists, relevant CAC staff, and prosecutors when needed. Team members must have and keep needed training, including on special victims’ crimes. CAC staff assigned to a case get the case information they need for interviews, treatment, medical care, and advocacy, except for classified material, confidential informant identities, or other investigative information outside CAC practice standards. CACs must share interview recordings, medical reports, and case docs with the FBI. The FBI will report yearly to the Attorney General whenever an interview happened without a team or trained interviewer and must explain urgent reasons. The Director should seek a memorandum of understanding with a national CAC accreditor to make CAC services available to FBI field offices and support trauma-informed, victim-centered case review. The FBI may give security clearances to eligible CAC staff when needed and funded. Nothing in the law expands FBI investigative authority or forces the sharing of protected classified information.
