District courts that use alternative dispute resolution must make neutrals available for every type of ADR they offer. Each court must set its own procedures and criteria for choosing who will serve on its neutral panels. Neutrals must be qualified and trained. Courts can use trained magistrate judges, private professional neutrals, or other trained people. Until rules are made under chapter 131, each district court must issue rules under section 2071(a) about when a neutral must be disqualified, including disqualification under section 455, other law, and professional ethics.
