Title 29 › CHAPTER 18 — EMPLOYEE RETIREMENT INCOME SECURITY PROGRAM › SUBCHAPTER I — PROTECTION OF EMPLOYEE BENEFIT RIGHTS › Subtitle A — General Provisions › § 1003
The law covers employee benefit plans set up or run by employers or worker groups that do business in commerce or in industries or activities that affect commerce. It does not apply to certain plans: government plans; church plans that have not made the election under 26 U.S.C. 410(d); plans kept only to meet workers’ compensation, unemployment, or disability insurance laws; plans maintained mainly outside the United States for nonresident aliens; and unfunded excess benefit plans. Also, Part 7 of Subtitle B does not apply to a health insurer just because it provides group health coverage if the subchapter does not apply to that group health plan. If a pension plan lets employees make voluntary contributions to accounts or annuities under 26 U.S.C. 408(q), those accounts and contributions are not treated as part of the pension plan (or as a separate pension plan) for this subchapter except for the rules about exclusive benefit and fiduciary/co‑fiduciary duties (sections 1103(c), 1104, and 1105) and the administration and enforcement rules in Part 5. Those rules apply to these accounts much like they do to simplified employee pensions under 26 U.S.C. 408(k).
