Title 29 › Chapter 18— EMPLOYEE RETIREMENT INCOME SECURITY PROGRAM › Subchapter I— PROTECTION OF EMPLOYEE BENEFIT RIGHTS › Subtitle Subtitle B— Regulatory Provisions › Part 5— administration and enforcement › § 1148
The Secretary can allow pension and other employee benefit plans, and people tied to them (like sponsors, administrators, participants, or beneficiaries), to ignore deadlines for up to 1 year when they are harmed by a presidentially declared disaster, a terroristic or military action, or an HHS-declared public health emergency. The Secretary may give that extra time by notice or other announcement, even if other laws say otherwise, and a plan won’t be treated as out of compliance just because it used the extra time.
