The Secretary may order a multiple employer welfare arrangement (see section 1002(40)), except plans outside section 1002(40)(A), to stop activities immediately (an ex parte cease-and-desist) or to seize assets if the arrangement seems fraudulent, poses an immediate danger to public safety or welfare, is causing or likely to cause significant, imminent, and irreparable public injury, or is financially hazardous. Anyone harmed can ask for a confidential hearing. The person asking must prove why the order should be lifted. After the hearing, the Secretary may affirm, change, or cancel the order. The Secretary may make rules to carry out these powers.
