Title 29 › CHAPTER 18 — EMPLOYEE RETIREMENT INCOME SECURITY PROGRAM › SUBCHAPTER I — PROTECTION OF EMPLOYEE BENEFIT RIGHTS › Subtitle B — Regulatory Provisions › part 7 — group health plan requirements › Subpart B — Other Requirements › § 1185o
Plans, insurers, and the companies that run drug benefits must include contract terms, starting for plan years that begin on or after 30 months after February 3, 2026, that let the plan’s pharmacy benefit manager (PBM) get and share data. PBMs must give the group health plan regular reports at least every 6 months (or quarterly if the plan asks). The reports must be easy to read and machine-readable. They must show, for each drug and drug class during the reporting period, things like which drugs had claims, how much the plan and pharmacies were paid, the difference between those amounts, whether a drug was brand or generic, wholesale or average price, counts of claims and dosage units, net and gross spending, out-of-pocket costs for participants, amounts of rebates or other payments to the plan and to the PBM, and special details for very high‑cost drugs (over $10,000) and for pharmacies owned by the PBM. Plans must also get and give short summary documents to help choose PBMs or explain benefits to participants, and participants can ask for the summary and for claim-level info about their own prescription showing the payment difference. Reports and disclosures must follow privacy rules like HIPAA and contain only summary health information when required. Plans must tell participants in writing each year that these reports are made. The Department of Health and Human Services will set a standard file format and other rules within 18 months after February 3, 2026, and the Secretary may create a shorter report for plans tied to drug makers or wholesalers to avoid anti-competitive behavior. Definitions used include: applicable entity (manufacturers, wholesalers, group purchasers, affiliates, or others the Secretary names), applicable group purchasing organization (one tied to a PBM), contracted compensation (ingredient cost plus dispensing fee), gross spending (before rebates), net spending (after rebates), plan sponsor (who runs the plan), remuneration (payments as the Secretary defines), specified large employer and specified large plan (those with about 100 or more employees or participants), and wholesale acquisition cost (the standard wholesale price).
