Title 29 › CHAPTER 9 — PORTAL-TO-PORTAL PAY › § 252
Employers do not have to pay or be punished for failing to pay minimum wages or overtime for work an employee did before May 14, 1947, unless that work was supposed to be paid under a contract (written or unwritten) that existed then, or under a regular workplace custom or practice in effect then that did not conflict with any contract. Work counts as payable only for the part of the day that the contract or custom said it was payable. Only time that was payable under those rules counts as hours worked for minimum-wage and overtime purposes. Courts cannot hear cases, from before or after May 14, 1947, that try to make employers pay for work that was not payable under those contract or custom rules. Claims for unpaid pay that arose before May 14, 1947 cannot be transferred to someone else if they are based on work that was not payable under those rules.
