If you sue on or after May 14, 1947 to recover unpaid minimum wages, unpaid overtime, or liquidated damages under the Fair Labor Standards Act, the Walsh‑Healey Act, or the Bacon‑Davis Act, you must bring the case within two years from when the claim began. If the employer acted willfully, you have three years. If the claim began before May 14, 1947, you must sue within the shorter of two years after it began or your State’s time limit, except a suit filed within 120 days after May 14, 1947 is allowed unless State law already barred it. For cases under section 216(b) against a State or political subdivision filed in federal court on or before April 18, 1973, the time limits were paused from the filing date until 180 days after the effective date of the Fair Labor Standards Amendments of 1974, unless the court ruled against the plaintiff for reasons other than State immunity.
