Title 29 › CHAPTER 31 — ASSISTIVE TECHNOLOGY FOR INDIVIDUALS WITH DISABILITIES › § 3007
The head of the Administration for Community Living at HHS must run the programs in this law. They must work with parts of the Departments of Education and Labor and other federal groups. Programs must serve people with all kinds of disabilities at every age and support using assistive technology at work, school, and in the community. Each year, no more than 1/2 of 1 percent of the chapter’s total money can be used for administration. The Secretary of HHS will check that grant recipients follow the rules and meet measurable goals. States may have to give information to help with those checks and the annual report. If a grantee is not following the rules or not making progress, the Secretary will help them make a corrective plan within 90 days. If they still fail during the fiscal year, the Secretary can stop or cut funding, bar them from the program next fiscal year, reduce money allowed for indirect costs next fiscal year, or require a new lead agency. The Secretary must set up appeals, include all such actions and outcomes in the yearly report, and post notice on the HHS website within 30 days. By December 31 each year the Secretary must send a report to the President and to the Senate Committee on Health, Education, Labor, and Pensions and the House Committee on Education and Labor that summarizes state progress reports, state applications, and how states are meeting their goals. Nothing here limits other enforcement powers, and these rules cannot be used to cut or change other federal medical or benefit assistance or eligibility.
