It is illegal while a lower-level union unit is in trusteeship (under the parent union’s control) to count that unit’s delegates at any union convention or officer election unless those delegates were picked by secret ballot in an election where all members in good standing could vote. It is also illegal to send that unit’s current receipts or other funds to the parent union, except the normal per capita tax and assessments paid by units not in trusteeship. If a union honestly dissolves, its assets may be distributed under its constitution and bylaws. Anyone who willfully breaks these rules can be fined not more than $10,000, jailed for not more than one year, or both.
