Title 29 › Chapter 4B— FEDERAL EMPLOYMENT SERVICE › § 49h
States must set up fiscal controls and fund-accounting systems to make sure federal money under this chapter is spent and tracked correctly. The Director of the Office of Management and Budget, working with the Comptroller General, will issue guidance for audits, including review of those state systems. States must get an independent financial and compliance audit at least once every two years. Each audit must follow the Comptroller General’s applicable auditing standards for financial and compliance work. The Comptroller General will evaluate state spending and program effectiveness, can inspect and copy state records for that purpose, and will report findings to Congress. This does not remove the Inspector General of the Department of Labor’s duties under chapter 4 of title 5. States must repay any money found to be spent incorrectly, but only after notice and a fair hearing; the Secretary may offset those amounts against other funds under this chapter.
