Title 29 › CHAPTER 16 — VOCATIONAL REHABILITATION AND OTHER REHABILITATION SERVICES › SUBCHAPTER V — RIGHTS AND ADVOCACY › § 794d
Federal agencies must make their electronic and information technology usable by employees with disabilities and by members of the public with disabilities, so they can access information like people without disabilities. If making the technology fully accessible would cause an undue burden, the agency must give the person an alternative way to get the same information. The rule does not apply to national security systems. Agencies do not have to provide government-owned equipment at a different location or buy equipment for other locations, and they do not have to add specific accessibility software or devices at a non-disabled employee’s workstation unless the Access Board’s standards require it. The Architectural and Transportation Barriers Compliance Board (the Access Board) must, within 18 months after August 7, 1998, define “electronic and information technology” consistent with federal law and publish technical and performance standards. The Board must review and update those standards over time. Within 6 months after the Board publishes standards, the Federal Acquisition Regulatory Council and each agency must update procurement rules. Agencies had to evaluate their technology accessibility within 6 months after August 7, 1998 and send the results to the Attorney General. The Attorney General must report to the President 18 months after August 7, 1998 and then every 2 years starting 3 years after August 7, 1998. Six months after the Board’s final standards are published, people with disabilities may file complaints with the agency; agencies must use the required complaint procedures and the civil remedies in law sections 794a apply. GSA and the Access Board will give technical help. This law does not cut off any other federal disability rights or remedies.
