Title 3 › Chapter 1— PRESIDENTIAL ELECTIONS AND VACANCIES › § 12
If, after the electors meet, a State’s electoral vote certificate has not reached the President of the Senate or the Archivist of the United States by the fourth Wednesday in December, the President of the Senate must quickly ask the State’s chief election officer to send the certificate. If the President of the Senate is away from the seat of government, the Archivist makes the request. The chief election officer must immediately send the certificate to the President of the Senate at the seat of government by the fastest method available.
