An employing office must not hurt or punish a worker who is serving in the uniformed services. It must not treat them unfairly, refuse to put them back to work when their service ends, or deny them certain job-related benefits. An "eligible employee" is a covered worker serving in the uniformed services whose service has not ended for the reasons listed in section 4304 of title 38. If an employer breaks these rules, the worker can get damages like those under section 4323(d) of title 38. The President, or someone the President chooses, must write rules to make the law work. Those rules should match the Department of Labor’s rules unless there is a good reason to change them. The rules take effect either when they are issued or on October 1, 1998, whichever comes first.
