Title 30 › CHAPTER 25 — SURFACE MINING CONTROL AND RECLAMATION › SUBCHAPTER V — CONTROL OF THE ENVIRONMENTAL IMPACTS OF SURFACE COAL MINING › § 1271
The Secretary must act when told or when inspection shows a mine is breaking the rules. The Secretary first notifies the State regulators. If the State does not fix the problem or explain why within 10 days, the Secretary will order a federal inspection unless a federal inspection already produced the information. The 10-day wait can be skipped if the tip includes proof of an immediate danger to people or the environment and the State did not act. If someone reports a problem, the Secretary must tell that person before a federal inspection and let them join the inspector. If a federal inspection finds a danger to public health or serious, imminent harm to land, air, or water, the Secretary must order the mine to stop the affected work right away and keep it stopped until the problem is fixed. The Secretary can also force the operator to take steps to fix the danger. If the violation is not an imminent danger, the Secretary gives the operator up to 90 days to correct it and offers a hearing. If the operator does not fix it, the Secretary can order work stopped and set steps to correct the problem. For repeated, willful, or unjustified failures to follow rules, the Secretary can order the operator to show cause and then suspend or revoke the permit after a hearing. Notices and orders must be written, signed, describe the violation, the fix required, the time limit, and the part of the mine affected, and be sent to the operator and the State. Cessation orders end after 30 days unless a public hearing is held at or near the site. The Secretary can ask the Attorney General to go to federal court for injunctions or other relief if an operator disobeys orders, blocks inspectors, or refuses records. Approved State programs must have enforcement penalties at least as strong and similar procedures.
