Title 30 › Chapter 12A— ENTRY AND LOCATION ON COAL LANDS ON DISCOVERY OF SOURCE MATERIAL › § 541b
Gives a mining claimant the right to mine, remove, and handle lignite that contains valuable source material, and to remove any lignite that must be taken out to get that source material. This applies when a claim is made under U.S. mining laws (including chapter 12) on lands described in section 541, so long as the discovery is in deposits that are not Leasing Act minerals and the land is not already inside the outer boundaries of a prior coal prospecting permit or lease. The claimant must file an adequate description of the claim in the land office named in section 541 and follow the reporting and payment rules in section 541 and the Atomic Energy Act of 1954 (42 U.S.C. 2011 et seq.). Does not reduce or limit rights from a mining claim under the 1872 Mining Act, and does not create extra duties for removing source material that is not in any seam, bed, or deposit of lignite.
