Title 30 › Chapter 15— SURFACE RESOURCES › Subchapter II— MINING LOCATIONS › § 614
An owner of an unpatented mining claim may give up rights that conflict with the limits in section 612 by signing and recording a waiver where the claim’s location notice or certificate is filed. Once recorded, and until a patent is issued, the claim is treated as if it were located after July 23, 1955. The waiver does not change the claim’s priority date or its validity.
