Title 30 › Chapter 20— CONVEYANCES TO OCCUPANTS OF UNPATENTED MINING CLAIMS › § 701
The Secretary of the Interior can give land rights to a person living on an unpatented mining claim that the Secretary finds to be invalid. The transfer can be up to full ownership (fee simple) for no more than five acres or the area the person actually uses, whichever is smaller. It also applies if, after notice from a qualified officer, the occupant gives up all rights to the United States. Only people who meet the "qualified applicant" rules in section 702 may apply. They had to apply by June 30, 1971 and pay the amount set under section 705. A "qualified officer of the United States" means the Secretary or a Department of the Interior employee he names, and he may let other department heads name officers for lands they manage.
