Title 30 › CHAPTER 22 — MINE SAFETY AND HEALTH › SUBCHAPTER I — GENERAL › § 814
When an inspector finds a health or safety problem at a coal or other mine, the Secretary or the inspector must quickly give the mine operator a written citation. The citation must say what the problem is, point to the rule it breaks, and set a reasonable time to fix it. If a problem is not fixed in time and the inspector decides not to extend the deadline, the inspector will mark the area and order everyone out of that area until the problem is fixed. People allowed to stay or enter are only those needed to fix the problem, public officials doing their jobs, qualified miners’ representatives (or those with them), and their consultants. If a violation is caused by the operator’s serious failure to follow rules, that finding will be put in the citation. If another similar serious violation is found within 90 days, the inspector must order an immediate withdrawal from the affected area. If similar violations keep showing up, withdrawal orders continue until inspections find no similar violations. If the operator has a pattern of dangerous violations, the operator gets written notice; further similar violations within 90 days can trigger withdrawal orders until a full inspection shows the pattern is gone. The Secretary will make rules about what counts as a pattern. If dust tests show the legal limit for respirable dust is exceeded, the Secretary or inspector will cite the operator and require dust samples each production shift. If the problem is not fixed in time, the inspector can order withdrawal of persons from the affected area until the limit will be met when work resumes. On request, the Secretary will send a dust-control expert or team to help the operator and may require steps to protect health. If an inspector finds a miner who lacks required safety training, the miner must be removed until they get the training. That miner cannot be fired or lose pay while getting the required training and until an inspector confirms it. Citations and orders stay in effect until changed by the Secretary, the Commission, or a court.
