Money an agency can use for a contract stays available for 100 days after the final ruling on a protest or similar challenge, even if another law would say otherwise. A ruling is final on the later of when the time to appeal runs out or when an appeal decision is issued. This applies to protests under subchapter V of chapter 35 and to other administrative or court challenges to a solicitation, a proposed award, an award, or a bidder’s/contractor’s eligibility that delay the agency from making the award.
