When someone wins money from the United States, the Treasury Secretary must hold back the part that equals any debt that person owes the government. If the person agrees, the debt is paid and the judgment is reduced by that amount. If the person denies the debt or won’t agree, the Treasury can hold back extra to cover legal costs and must file a lawsuit if needed. If the government loses that lawsuit or collects less than it held back, the Treasury must pay the difference plus 6 percent interest for the time the money was kept.
