Pays a survivor annuity to a Comptroller General’s family when four things are true: the Comptroller General made the election under section 773, died in office or while receiving an annuity under section 772, had at least 18 months of civilian service at death, and had the required deductions or deposits made for the last 18 months of that civilian service. Allowable military service: up to 5 years of honorable active duty (including Guard on federal orders) not counted elsewhere. Other prior allowable service: civilian Government or D.C. officer/employee service not covered above. Congressional employee: the same meaning as in 5 U.S.C. 2107. If only a spouse survives, the spouse gets an annuity starting at the death or when the spouse turns 50, whichever is later. If a spouse and dependent children survive, the spouse gets an immediate annuity and each child gets the smaller of 10% of the average pay or 20% of the average pay divided by the number of children. If only children survive, each child gets the smallest of three amounts: the spouse’s share divided by the number of children, 20% of the average pay, or 40% of the average pay divided by the number of children. The spouse’s annuity is calculated from the average pay (based on the highest 3 years) using 1.5% times years as Comptroller General or member of Congress and allowable military service (plus up to 15 years of congressional employee service), plus 0.75% times years of other allowable service. The spouse’s annuity cannot be more than 50% or less than 25% of that average pay. If required deposits were not made, that service can still count unless the spouse says no, but the annuity is reduced by 10% of the unpaid deposit amount as of the date of death.
