You can sue a surety company that gave a bond under section 9304 in a federal court either where the bond was given or where the company’s main office is. Under sections 9304–9308, a bond counts as given in any district that is the company’s main office district, the district the bond is returnable to, the district where the bond is filed, or the district where the person who had to provide the bond lived when it was given. The surety company cannot claim it did not have the power to issue the bond or to be liable for it.
