Title 32 › Chapter 3— PERSONNEL › § 302
Under rules the Secretary sets, the National Guard may take original enlistments of at least 3 years for people who never served and at least 1 year for people who have served. Reenlistments may be any fixed term or open-ended if the person last held one of the five highest enlisted grades. Enlistments or reenlistments can be extended at a member’s request for any period of at least 6 months, or by the President if Congress declares an emergency, until six months after that emergency ends.
