Title 32 › Chapter 3— PERSONNEL › § 304
People who join the National Guard must sign an enlistment contract and take an oath. The oath records the date, the Guard unit, and the length of service. Recruits promise they joined voluntarily, that they will support and defend the U.S. Constitution and their state’s constitution, be loyal to them, and obey lawful orders from the President, the state Governor, and the officers placed above them. The oath can be sworn or simply affirmed and may include a religious closing. It may be given by a National Guard officer in that state, territory, Puerto Rico, or the District of Columbia, or by any person local law allows to administer enlistment oaths.
