States must set the priority order for publicly owned wastewater construction projects. The Administrator may remove a specific project after a public hearing if it will not meet the law’s enforceable requirements, and the State must send a revised priority list. The categories cover seven types, such as treatment upgrades, stricter treatment, fixing infiltration/inflow, major sewer rehabilitation, new collector sewers and interceptors, and correcting combined sewer overflows. Not less than 25% of the funds allocated to a State in any fiscal year for these works must be used for major rehab, new collectors or interceptors, and fixing combined sewer overflows if those projects are on the State’s list and eligible that fiscal year. Federally assisted projects should be those the State believes will best manage water quality and protect public health.
