Title 33 › CHAPTER 26 — WATER POLLUTION PREVENTION AND CONTROL › SUBCHAPTER IV — PERMITS AND LICENSES › § 1346
Requires the EPA to write rules, within 18 months after October 10, 2000, for how beaches and similar public coastal waters must be tested for harmful germs and how the public must be told quickly if water quality limits are exceeded or likely to be exceeded. EPA must make the rules after talking with federal, state, tribal, and local officials and after giving the public a chance to comment. The rules must protect public health. EPA may give grants to states and local governments to build and run these testing-and-notice programs if the programs follow EPA’s rules, prioritize waters by how people use them and health risk, share prioritization factors, list the exact waters covered, and let the public review the program. EPA can pay up to 100% of costs through grants. The nonfederal share may be up to 50% as set by EPA. Grants to local governments can be made only if, after the 1-year period beginning when EPA publishes the rules, EPA finds the state is not running a suitable program. Programs that get grants must identify the coastal waters covered; how the state may delegate work to local governments; where and how often to test based on use, pollution sources, and storms; methods to detect pathogens and short-term spikes; quick ways to notify EPA and local officials; signs or equivalent notices to warn the public; and information about health risks from water contact. Federal agencies must set up similar programs within 3 years after October 10, 2000. EPA must keep a public electronic database of monitoring data and must list and periodically update which waters have or do not have monitoring programs. EPA will give technical help on monitoring floatable material. If a state still has no acceptable program 3 years after EPA lists its waters, EPA will run monitoring and notification for those waters. Congress authorized $30,000,000 per year for grants for fiscal years 2001 through 2005.
