Summary

The Attorney General, if the Secretary asks, can go to U.S. district court near the port or where the licensee lives or can be found to stop a license when a licensee breaks the rules. If the licensee knowingly keeps breaking the rules for 30 days after the Secretary sends a registered letter to the licensee’s official mailing address, the Attorney General can ask the court to cancel the license. If the Secretary finds an immediate threat to public health or safety or a serious, imminent danger to the environment, the Secretary can order the licensee to stop or change construction or operation right away until the court case above is finished.
