Title 33 › Chapter 33A— MARINE DEBRIS RESEARCH, PREVENTION, AND REDUCTION › Subchapter II— MARINE DEBRIS FOUNDATION › § 1962
Creates a Board of Directors for the Foundation made up of the Under Secretary plus 12 U.S. citizen members. The Board must include a mix of viewpoints on marine debris. Being a Director does not make someone a federal employee or holder of a federal office. The Board sends candidate recommendations, and the Under Secretary, after consulting the EPA Administrator, the Director of the U.S. Fish and Wildlife Service, the Assistant Secretary of State for the Bureau of Oceans and International Environmental and Scientific Affairs, and the Administrator of USAID, and with the Secretary of Commerce’s approval, must appoint the 12 Directors. At least 4 must have marine debris expertise (including post-consumer materials or circular economy), 2 must have marine debris experience outside the U.S., 2 must have ocean or coastal conservation science or policy experience, and 2 must have international trade or foreign policy experience. Directors serve 6-year terms, may not serve more than 2 consecutive terms (excluding any term under 6 years), and vacancies are filled by the Under Secretary with Secretary approval. The Board elects a Chair for 2 years, a majority is needed to act, the Board must meet at least once a year, members are unpaid but get travel costs, and missing 3 regular meetings can lead to removal. The Board can set up the Foundation, hire officers once funds exist (not under standard federal hiring rules), and the first hire is the Secretary of the Board who serves as chief executive and must know about marine debris. The Board appoints and can remove the CEO, who in turn manages other staff.
