Title 33 › Chapter 36— WATER RESOURCES DEVELOPMENT › § 2203
The Secretary must finish, within 180 days after December 27, 2020, a review of the Army Corps of Engineers’ rules and guidance for making contracts with non‑Federal partners and utilities for water projects. Within 90 days after that review is done, the Secretary must send a report to the House Committee on Transportation and Infrastructure and the Senate Committee on Environment and Public Works and post it for the public. The report must summarize the review and give public best‑practice guidance for non‑Federal parties when they write or prepare contracts with the Secretary and utilities. The Secretary must give that guidance to non‑Federal parties before contract development. Congress also says the Secretary should, as much as possible, use competitive buying methods that consider factors other than price when hiring for emergency work in areas where the President has declared a major disaster under section 5170 of title 42.
