Title 33 › Chapter 36— WATER RESOURCES DEVELOPMENT › Subchapter V— GENERAL PROVISIONS › § 2325a
The Secretary can take and use materials, services, or money from state, local, nonprofit, or private groups to fix, restore, replace, or maintain a water resources project when the District Commander finds two things: the project faces a risk to how it works, and taking the help is in the public interest. People or groups that give materials or services must not get paid back or get credit for their value. Any donated items or work must follow the same laws and rules as if the Secretary bought them. Donated services can only add to existing Federal staff and may be used only for work that would not get done because of money or staff limits. No later than February 1 each year after the first fiscal year any donations are accepted, the Secretary must send a report to the Senate Committee on Environment and Public Works and the House Committee on Transportation and Infrastructure. The report must describe the activities and costs and explain fully why the activities were needed to keep the water resources project safe and reliable.
