The Secretary can give technical planning and design help to non-Federal groups and do site studies to create fish screens, fish passage devices, and other ways to keep juvenile and adult fish from accidentally entering irrigation systems. Those projects must be done with Federal and State resource agencies and must not stop farmers or others from taking water for irrigation. Priority must go to actions that match the goals of the Endangered Species Act of 1973, are cost-effective, and can reduce fish deaths. Non-Federal interests must pay 50 percent of the cost, and no more than 50 percent of that share can be in-kind (services, materials, or supplies). This does not allow any construction work. Within 2 years after August 17, 1999, the Secretary must report to Congress on fish deaths from irrigation intakes, possible fixes, how widely those fixes are used in arid States, the construction costs for the fixes, and what Federal role, if any, is appropriate to encourage their use.
