Within 90 days after getting a complete application for a water storage project, the District Engineer must prepare and give the applicant a purpose-and-need statement. The statement must say whether the District Engineer agrees with the applicant’s stated purpose and need, and if not, must include the District Engineer’s own assessment. An environmental impact statement or environmental assessment under the National Environmental Policy Act (42 U.S.C. 4321 et seq.) may not substantially start until that statement is given. A non-Federal interest may use the administrative appeals process in 33 CFR part 331 (or any replacement) for Secretary decisions about the application.
