The Secretary must send two reports required by earlier Water Resources Development Acts (one from 2018 and one from 2016) no later than 180 days after December 27, 2020. The Secretary must follow any Executive order on environmental justice that was in effect on December 27, 2020 when planning water projects. Within 1 year after December 27, 2020, the Secretary must review and, if needed, update Corps of Engineers policies, rules, and guidance to carry out that Executive order. While updating, the Secretary must notify non‑Federal stakeholders (including minority and low‑income communities and Indian Tribes), let stakeholders comment, consider the two reports, and encourage real, active participation by those communities and Tribes. When building or operating water projects, the Secretary must, as much as reasonably possible, encourage genuine participation from minority and low‑income communities and Indian Tribes, offer guidance and technical help so they can understand project plans and rules, and work with state, Tribal, and local governments. The Secretary must also follow the Tribal Consultation Policy adopted November 1, 2012 (or a successor policy) to consult Tribes near project sites about ancestral, cultural, religious, and livelihood resources and to try to avoid harm or find alternatives.
