§2604 Suspension, Revocation, and Injunctions

Summary

The Secretary of Transportation can suspend or cancel a vessel’s permit if the vessel breaks this law or its rules, but only after giving notice and a chance for a hearing. If the Administrator asks, the Secretary must suspend or cancel the permit. The Secretary or the Administrator can also go to the U.S. district court where the violation happened and ask a judge to order the operation to stop.

(a)After notice and opportunity for a hearing, the Secretary of Transportation may, and at the request of the Administrator shall, suspend or revoke a permit issued to a vessel under this chapter for a violation of this chapter or a regulation prescribed under this chapter.
(b)The Secretary or the Administrator may bring a civil action to enjoin any operation in violation of this chapter or a regulation prescribed under this chapter in the district court of the United States for the district in which the violation occurred.
