When the President learns about a spill or threat, the President must, when possible, name the source or sources. If the source named is a ship or a facility, the President must tell the responsible party and any guarantor right away. If that party or guarantor does not deny the naming within 5 days, they must run ads explaining the naming and how people can file claims, following rules the President sets. Those ads must start no later than 15 days after the naming and run for at least 30 days. If they don’t place the ads, the President will run them and charge the responsible party or guarantor. The ads must say that people can file interim, short-term claims for less than their total damages, and getting such a payment does not stop them from later seeking the rest. The law also lists three special cases: both the responsible party and guarantor deny the naming within 5 days, the source was a public vessel, or the President cannot identify the source.
