States and local governments keep the power to add rules or make people legally responsible for oil spills, cleanup work, or related matters. Nothing in this Act or the Act of March 3, 1851 changes duties under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.) or state law, including common law. States may create or keep a fund to pay oil pollution costs and can require people to pay into that fund. The United States and states may also add extra requirements or decide fines or penalties (civil or criminal). Chapter 305 of title 46 and section 9509 of title 26 are not changed. For purposes of section 2679(b)(2)(B) of title 28, these laws do not create a new right to sue a Federal officer or employee in their personal capacity for acts done while performing their job.
