A federal estuary habitat restoration program lets the Secretary fund and run estuary restoration projects and give technical help through contracts and agreements. Projects must start with a non-Federal group and follow State or local law. The Secretary will pick projects from a list sent by the Estuary Habitat Restoration Council. Each chosen project must match an estuary restoration plan, follow the program’s overall strategy, include a monitoring plan that meets the program’s monitoring standards, and have a written promise from the non‑Federal group that it has the people, money, and authority to do local parts and keep the project in good shape. When picking projects, the Secretary will look at things like whether a project fits existing plans, is technically and scientifically sound, boosts cooperation among governments and the private sector, uses funds well, and whether the State has dedicated estuary funding. Projects get priority if they are in watersheds with programs tackling pollution that could undo the work or if they test new cost-saving methods. The federal share of project costs (not including ongoing operation and maintenance) is usually up to 65%. Monitoring costs can be included and must show effectiveness and allow changes if needed. The federal share of extra costs for testing new methods can be 85%. Before a final strategy is ready, the federal share for interim actions is capped at 25%. Non‑Federal partners must provide lands, rights, or in‑kind help for their share and must pay for long‑term operation and repairs. A nonprofit group can act as the non‑Federal partner. The Secretary may delegate work to other federal agencies; small projects with federal costs under $1,000,000 can be handed to Interior (USFWS), Commerce (Oceans and Atmosphere), EPA, or Agriculture and may use those agencies’ funds, but they must follow the same agreement and cooperation rules.
