Last updated Apr 5, 2026|Official source

Summary

When an officer in the commissioned corps is promoted to a higher rank, they are treated as having accepted that promotion on the day the President makes it unless they clearly refuse it. They must be paid the higher rank's pay and allowances from that same day, unless another law says they get that pay from an earlier date. If the officer already took the oath required under section 3331 of title 5 and has served continuously since then, they do not have to take the oath again when promoted.
