Officers of the Administration who are on active duty must be treated the same as active military service members for certain benefits and protections under three sets of laws: laws run by the Secretary of Veterans Affairs; the Servicemembers Civil Relief Act (50 U.S.C. 3901 et seq.); and section 410 of title 42 as it stood before September 1, 1950. When those laws and rules apply to the Administration, the Secretary of Commerce will use the powers that would otherwise belong to the Secretary of Defense and the military department secretaries.
