The Secretary may investigate and inspect vessels to check if they follow this chapter and the Convention. During an investigation, the Secretary can issue a subpoena — a legal order to make someone appear or hand over documents — but only after asking the Attorney General if the subpoena would interfere with any criminal case. If the Attorney General says it won’t, or does not answer within 30 days of the request, the Secretary can issue the subpoena. If a person refuses, the Secretary can ask the Attorney General to ask a federal district court to force compliance. When an investigation ends, the Secretary may take any actions allowed under the Convention or this chapter. The Secretary may also work with other parties to the Convention to find and enforce violations. This does not change requirements in other laws.
