People who are found, after being told and given a chance to be heard, to have broken the Convention, this chapter, or rules under it must pay civil fines. Breaking the rules can bring a fine up to $37,500 for each violation. Making a false or fake statement when a statement is required can bring a fine up to $50,000 for each false statement. If the violation involves a recreational boat, the fine cannot be more than $5,000 for each violation. Each day a violation continues counts as a separate violation. This does not limit the Government’s authority under 18 U.S.C. 1001. The Secretary or Administrator (whichever is in charge) sends a written notice to set the fine. They must consider how serious the act was, fault, past offenses, costs or benefits to the violator, and other fair factors when deciding the amount. Up to half of a collected fine may be paid to someone who provided information that led to the fine, if money is available. If a person won’t pay, the matter can be sent to the Attorney General for collection. The Secretary or Administrator can settle, change, or cancel a fine before sending it for collection. Late payment also brings interest at 11% per year compounded quarterly, lawyer fees and collection costs, and a 20% extra charge each quarter on the unpaid total.
