§3914 Requirements

Summary

Projects paid for under this chapter must use only iron and steel products made in the United States for construction, alteration, maintenance, or repair, unless the Administrator allows an exception. "Iron and steel products" means items mostly of iron or steel, for example pipes and fittings, manhole covers and municipal castings, hydrants, tanks, flanges, clamps, valves, structural steel, and reinforced precast concrete. The Administrator can waive the rule if it would harm the public interest, if U.S. products aren’t available in sufficient quantity or quality, or if using them would raise project cost by more than 25 percent. Waiver requests must be posted publicly (including on the EPA website) and allow at least 15 days for informal public comment. The requirement must be applied consistently with U.S. international agreements.
