Title 33 › Chapter 9— PROTECTION OF NAVIGABLE WATERS AND OF HARBOR AND RIVER IMPROVEMENTS GENERALLY › Subchapter I— IN GENERAL › § 419
The Secretary of the Army may make rules about moving and dumping dredged material, dirt, garbage, and other waste into navigable waters or waters next to them when needed to protect navigation. The rules must be posted where the public can see them. Anyone who breaks the rules is guilty of a misdemeanor and faces the penalties listed in sections 411 and 412 for violating section 407. The rules can be enforced as described in section 413. These rules do not apply to waters inside a State that are used for oyster farming under that State’s laws, except for navigable channels improved or declared navigable by the United States. When the United States improves a channel, dredged material must not be placed on oyster grounds except under the State’s law. Costs to carry out the rules may be paid from funds for the harbor or waterway being improved, or from congressional appropriations for river and harbor examinations, surveys, and contingencies.
