When a private party, company, or local government needs land or an easement for a Congress-approved river or harbor project, and plans to give the land or any locks, dry docks, or dams to the United States for free but cannot buy it or get clear title, the Secretary of the Army can start a legal process in the name of the United States to take the land. The Attorney General must run that case when the Secretary asks. The party that wanted the land must pay all court costs and any money awarded to owners. Before the case starts, the Secretary may require that party to put up a bond to guarantee those payments.
