The rule only covers areas that are or will be bulkheaded, filled, or used for permanent structures like marinas; such work must follow federal permits and environmental laws, and the nonnavigable label ends for any area still not filled or occupied 20 years from November 28, 1990, or if permitted work does not begin within 5 years after permits are issued.
