Declares part of San Francisco’s waterfront to be nonnavigable waters of the United States. The area lies shoreward of a specific Pierhead line and runs from the Earl Street/Marlette Street area past Pier 30–32 toward Van Ness Avenue, including land tied to those piers and the Pierhead line described in the law. That nonnavigable status only applies to parts that are filled, bulkheaded, or covered by permanent structures. It does not change how other federal laws apply, including sections 401 and 403 of this title, section 1344 of this title, and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). Congress also says this area contains the Embarcadero Historic District listed on the National Register on May 12, 2006.
