§59j–1 Declaration of Nonnavigability for Portions of the Delaware River

Summary

Certain parts of the Delaware River in Philadelphia are treated as not navigable unless the Secretary, after talking with local and regional public officials, finds the planned projects there are not in the public interest. The places named include Liberty Landing; Marina Towers and World Trade Center—Pier 25 North; Marine Trade Center—Pier 24 North; National Sugar Company “Sugar House”; and Rivercenter. That non‑navigable status only applies to portions that are or will be bulkheaded, filled, or covered by permanent structures (for example, marinas). Any work there must follow federal laws, including sections 401 and 403 and section 1344 of Title 33 and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). If, 20 years from November 17, 1988, an area is not filled or built as required, or if permitted work does not start within 5 years after permits are issued, the non‑navigable status for that area expires. The Rivercenter area does not expire.
