The Secretary of the Army must label certain waterfront parcels in West Deptford Township, Gloucester County, New Jersey, as nonnavigable (treated as not navigable), unless after talking with local and regional officials (including planning groups) he decides that one or more proposed projects in those areas would not be in the public interest. The parcels are shown on Tax Assessment Map #26, Block #328, Lots #1, 1.03, 1.08, and 1.09 and are described in detail in the law. That nonnavigable label only applies to parts of those parcels that are or will be bulkheaded, filled, or used by permanent structures (including marinas). Any such work must follow federal laws, including the Act of March 3, 1899 (30 Stat. 1121, chapter 425), section 1344 of this title, and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). If, 20 years after November 12, 2001, any part is not filled or otherwise occupied as required, or if authorized work does not start within 5 years after permits are issued, the nonnavigable label for that part ends.
