The Secretary of the Army, through the Chief of Engineers, can declare parts of the South Prong of the Wicomico River in Salisbury, Maryland, to be non-navigable and allow filling or permanent pile-supported structures there if engineering studies and environmental reviews under the National Environmental Policy Act show the project is in the public interest. The area covered runs from the west side of U.S. Route 13 to the west side of the Mill Street Bridge, and is bounded on the north and south by lines five feet landward from the current high-tide water’s edge along that stretch. That declaration only applies to places that are bulkheaded and filled or already have permanent pile-supported structures. Plans must be approved by the Secretary of the Army through the Chief of Engineers. The remaining river channel must stay at least 60 feet wide and at least 5 feet deep inside that width. Local parties must repay the federal government for engineering and other costs.
